If booked flights are cancelled, cancelled or rebooked by the airline, the passenger may be entitled to a refund of the ticket price and/or claims for damages and compensation. It can be difficult to make such claims to large aiirlines.

The Air Passenger Rights Regulation (EC) No. 261/2004 is the European law regulation that grants air passengers claims in the event of denied boarding, cancellation or long flight delays.

Claims may include full reimbursement of the cost of the flight already paid for, compensation based on a fixed flat rate. and reimbursement of additional accommodation and subsistence costs incurred due to flight delay.

With the reorganization of travel rights by the European Union, the German legislator made comprehensive changes in the package tour rights to the 01.07.2018 for the protection of the consumers. In case of travel mishaps, cancellation or rebooking, travelers are legally protected by §§ 651a ff. BGB. In addition to special rights of withdrawal, travelers can, in the event of travel mishaps, claim reductions in price in accordance with §§ 651i ff. BGB can make valid. Also beyond that, claims for damages according to § 651n BGB are granted. Claims can be brought directly against the tour operator, but also against the travel agent (e.g. the travel agency).
